1. Acceptance of these terms

These Terms of Use ("Terms") are an agreement between you and the developer of Xerizen. By downloading, installing or using the Xerizen app ("Xerizen", "the app"), you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

2. Who provides Xerizen

Xerizen is developed and provided by Nikolai Malinin, an individual developer ("the developer", "we", "us"). Contact: softmalinna@gmail.com.

3. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Xerizen on devices you own or control, for your own non-commercial use, in accordance with these Terms and the Google Play Terms of Service. You may not sell, rent, sublicense or redistribute the app.

4. What Xerizen is

Xerizen is a web browser: it lets you open and interact with third-party websites and content. It includes features such as NoADS ad-blocking, a Discover news feed, a Night Mood dark theme, tab management, downloads and a built-in media player. Features may be added, changed or removed over time.

Websites, search results, downloads, the Discover feed's linked articles, and any other content you reach through Xerizen are provided by third parties. We do not create, own, endorse or control that content, and we are not responsible for it. Your use of third-party sites is subject to their terms and privacy policies. Please browse responsibly.

7. Advertising

Xerizen may show advertising (for example, through Google AdMob) to keep the app free. By using the app you understand that ads may be displayed. Ad choices and consent are handled as described in our Privacy Policy.

8. Intellectual property

The Xerizen app, its name, logo and original design are the property of the developer and are protected by applicable laws. Xerizen is built with open-source and third-party components, which remain the property of their respective owners and are used under their own licences. Nothing in these Terms transfers ownership of any intellectual property to you.

9. Updates and availability

We may update the app and these Terms, and we may change, suspend or discontinue any part of the app at any time without notice. We don't guarantee that the app will always be available, uninterrupted or error-free.

10. Disclaimer of warranties

To the maximum extent permitted by law, Xerizen is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, or that the app or any content accessed through it will be accurate, safe or uninterrupted.

11. Limitation of liability

To the maximum extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of (or inability to use) the app or any third-party content accessed through it. Where liability cannot be excluded, it is limited to the greatest extent the law allows.

12. Termination

You may stop using Xerizen and uninstall it at any time. We may suspend or end your access to the app if you breach these Terms or misuse the service. Sections that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

13. Governing law and disputes

These Terms are governed by the laws applicable at the developer's place of residence, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights you have where you live. Disputes will be handled by the competent courts of that place, unless applicable law gives you the right to bring a claim elsewhere.

14. Changes to these terms

We may revise these Terms from time to time. The "Last updated" date above shows the current version. If you keep using Xerizen after changes take effect, you accept the revised Terms.
